What is a Wage Withholding Order?
A Wage Witholding Order (more properly entitled 'Wage Withholding Order to the Employer' is an order that the court sends to the employer of the person required to pay child support. It is strongly advisable for any person who wants to receive child support to have one of these drafted and entered if they actually want to receive the child support. For some reason, child support that remains in the hands of the person who is supposed to pay it seems to have a much higher probability of getting spent on other things. This can result in missing or late payments, problems trying to force the payments out of the other person, and possible jail for the other parent of your child. If the Wage Withholding Order is sent to the employer however, it gets taken out of the paycheck beforehand and prompt and timely payment is pretty much ensured. It generally costs $15 for the court to send the order to an employer. Of course, as needed, JH&A will always draft a Wage Withholding Order as a part of the Insta-File Agreed Divorce package.
