I can't find my spouse?
Yes and No. The good news is that for this type matter, we still offer our services for $175.00 plus filing fees. Assuming the divorce ends up being a 'default' divorce, it is not that much harder for us to draft the paperwork. The bad news is that the Texas Rules for Civil Procedure require that you first give notice to the missing spouse by publishing an ad in the newspaper. That incurs extra fees charged by the county and the newspaper. Then (yes, then) when the missing spouse fails to respond, you have to get ANOTHER attorney called an ad litem appointed by the Court to try to locate the missing spouse. The ad litem charges for this 'service' and you to pay for it. Often, the ad litem finds the missing spouse. Since the fact that the missing spouse is missing is a good indicator that he/she does not want to be married either, it is normally just easier and cheaper to ask around, find the missing spouse, and get them to agree to a divorce. (Or if you do not want to talk to the spouse or have them learn where you live, give us the information and we will do the communicating for you.)
